SUMMARY:WEBINAR - Fighting Money Laundering and Terrorism Financing Across the Globe – US and EU Reform Legal Frameworks
DESCRIPTION:[vc_row][vc_column][vc_column_text]The United States Congress kicked off the new year by enacting the Anti-Money Laundering Act of 2020\, which became law only after both houses of Congress overrode then-President Trump’s veto of the proposed legislation. The Anti-Money Laundering Act is one of the most significant reforms since the USA Patriot Act of 2001 almost 20 years ago. The European Commission published an action plan in May 2020 to strengthen its Anti-Money Laundering legal framework around six key pillars. The Commission just released a new legislative proposal [to be confirmed on 12 May]. Both reforms will significantly change the shape of AML/CFT on both sides of the Atlantic.\n\nTopics to be addressed: \n\nUS Anti-Money Laundering Act of 2020:\n●  Newly created beneficial ownership registry for shell companies\n●  Newly enhanced AML whistleblower program\n●  Extension of U.S. subpoena power over foreign banks\n●  Newly created crimes\, collateral punishments\, and increased penalties for AML violations\n●  Application of AML regulations to virtual currency and to the antiquities market\n\nReform of the EU’s Anti-Money Laundering Framework:\n●  The EU approach on Beneficial Ownership\n●  A single EU rulebook\n●  EU-level supervision\n●  A stronger EU in the world\n\nUS-EU: potential for cooperation to strengthen AML/CFT at a global level?\n\nWho should attend:\nEmployees\, directors\, and lawyers who represent U.S. and non-U.S. financial institutions should attend this panel discussion\, as the new legislation affects financial institutions doing business in the United States\, as well as foreign financial institutions that use correspondence accounts located in the United States.  In addition\, those involved in establishing or using offshore shell companies to access the U.S. financial system should be aware of the Act’s plan to bring those companies into the reach of U.S. anti-money laundering laws.\n\nNOTE: This program will not be recorded. If you would like to hear what our experts have to say be sure to join us live at the event\, you won’t be able to access the information presented afterwards.\n\nSPEAKERS:\n●  Matthew Moses\, Partner\, ORRICK\n●  Amy Walsh\, Partner\, ORRICK [Moderator]\n●  Martin Merlin\, DG FISMA’s Director for Bank\, Insurance and Financial Crime\n●  Jasper Verhoog\, Partner\, AKD\n●  Danielle Camner Lindholm\, Director of National Security Policy\, House Financial Services Committee\n\n \n\nREGISTER\n\nThis program is brought to you by EACCNY\n\n[/vc_column_text][/vc_column][/vc_row]

SUMMARY:WEBINAR - Prospects for Transatlantic Cooperation in the Post-Covid Era
DESCRIPTION:[vc_row][vc_column][vc_column_text]Brought to you by the EACC Texas.\n\nAs both the United States and the European Union seek to recover from the Covid-19 crisis\, the question is whether they can build back the transatlantic agenda for a new era marked by growing competition with China\, technological change\, and a global climate crisis. What are the political and economic prospects for Europe given a slower vaccination rollout and a smaller stimulus package compared to the U.S.? Where can the Biden administration and European capitals make quick progress on trade\, digital and climate issues over the next six to twelve months? How can the transatlantic relationship be retrofitted to better deal with a new set of challenges stemming from China’s global rise\, the need to diversify global supply chains\, lead on sustainability\, and lead on digital and technology issues?\n\nSPEAKERS\n\n●  Erik Brattberg\, Director of the Europe Program and Fellow at the Carnegie Endowment for International Peace in Washington\, D.C.\n●  Joanna Ridgway\,  Managing Director & Head of Southwest Region\, Mid-Corporate Bank at Santander Bank\, N.A. SUMMARY:WEBINAR - The EU’s Industrial Strategy and how U.S. Investors can get involved
DESCRIPTION:[vc_row][vc_column][vc_column_text]Europe is embarking on a transition towards climate neutrality and digital leadership. The European industrial strategy to be launched in the Spring of 2021 aims to ensure that European industry can lead the way as we enter this new age.\n\nThe strategy consists of three drivers to transform our industry\, support our small and medium-sized enterprises (SMEs) and keep Europe sustainable and competitive:\n●  Green transition\, supported by the European Green Deal\n●  Digital transition\, supported by the EU’s Digital Strategy\n●  Competitiveness on the global stage\, where Europe will leverage the influence of its Single Market to set global standards\n\nWith this unique initiative Europe is addressing the twin transition into a green and digital future\, the updated industrial strategy will include reflections on strategic dependencies of the European economy. A process similar to supply chain review started under the Biden Administration. This discussion will outline the multitude of issues that merit a transatlantic discussion and outline specific areas ripe for a closer cooperation.\n\nThe strategy also aims to unleash the potential of SMEs\, which are essential to Europe’s competitiveness and prosperity. SME’s will be supported by:\n●  encouraging innovation through new funding and digital innovation hubs as part of the sustainable and digital transitions\n●  cutting red tape by reducing barriers within the Single Market and opening up access to finance\n●  allowing better access to finance by setting up an SME Initial Public Offering Fund (with investments channeled through a new private-public fund) and the ESCALAR initiative (a mechanism to boost the size of venture capital funds and attract more private investment)\n\nOn all three fronts there will be opportunities for US and European investors to get involved.\n\nSPEAKERS:\n● Kerstin Jorna\, Director-General of the Directorate-General for Internal Market\, Industry\, Entrepreneurship and SMEs\n● Duncan Caird\, Managing Director\, Head Infrastructure\, Energy & Export Finance\, HSBC – TBC\n● Additional panelists TBA\n\nTIME:\n10:00am EDT / 16:00 CET\n\nREGISTRATION FEE:\nEACCFL Members: Free\nEACCFL non-Members: Free\n\nREGISTER HERE\nProgram brought to you by EACCNY \n[/vc_column_text][/vc_column][/vc_row]

SUMMARY:The U.S. Trademark Modernization Act: What Foreign Companies Need to Know
DESCRIPTION:[vc_row][vc_column][vc_column_text]Brought to you by EACC Paris.\n\nOne of the primary goals of the TMA\, which will be implemented by December 27\, 2021\, is to ensure the accuracy and reliability of the U.S. Trademark Registry by creating new tools and procedures for challenging applications and registrations with inaccurate claims of use. It has the potential to significantly impact trademark prosecution and registration in the U.S.\, particularly for foreign applicants/registrants who obtained a U.S. registration without having to establish use prior to registration.\n\nThis panel offers a unique opportunity to learn about the TMA from a variety of perspectives (USPTO and inside and outside counsel) and also to provide your comments and feedback to the USPTO on issues relating to its implementation.\n\nDiscussion points:\n\n What are the policy goals of the TMA and how will it impact trademark prosecution and enforcement in the U.S.? \n How will the new ex parte cancellation proceedings (both of which are aimed at removing unused marks from the register) impact foreign applicants/registrants? \n How does the TMA interact with other changes implemented by the USPTO to address concerns of fraud/non-use? \n What are the special considerations for foreign applicants/registrants seeking to register/maintain U.S. marks based upon foreign registrations (where proof of use is not initially required)\n What other considerations should foreign applicants/registrants keep in mind in order to prepare for the implementation of the TMA?\n\nSpeakers\n\n Amy Cotton\, Deputy Commissioner for Trademark Examination Policy at the USPTO\n Stephanie Espada\, In-house associate counsel at Lincare\n Laura Pitts\, Counsel at Buchanan Ingersoll & Rooney PC\n\nTo Register\, please contact Christina Sleszynska at csleszynska@eaccfl.com\nThis program is brought to you by EACC Paris \n[/vc_column_text][/vc_column][/vc_row]

SUMMARY:The New Post-COVID Supply Chain Paradigm
DESCRIPTION:The coronavirus pandemic has impacted companies around the world and caused major supply chain disruption. Our experts will analyze the effects on demand patterns and supply chain management globally and which of the new routines are here to stay.\n\nBesides the pandemic\, new geopolitical realities also have their effect on global supply chains. Trade and tariffs have become a tool of a larger foreign policy context\, and sale of\, or access to critical components has become the focus of security concerns.\n\nAll these factors drive the need to changing the nature of supply chains. To succeed we need to better understand the key drivers of change and disruption is step one. It affects every business\, although some industries are more affected than others due to geographical footprint\, production factors\, complexity\, or value. Supply chain management moved up on the agenda as the focus switched from “Optimization” to “Survival”.\n\nTo shine a light on how we are moving from Stage 1: “structuring supply chains for cost efficiency” to Stage 2: “diversification due to trade war implications” to Stage 3: “resiliency given disruptions from pandemic (logistics\, government intervention\, shut-downs)\, panelists will discuss:\n●  How diversified and/or dependent are the US and the EU supply chains\, and what critical for resilience?\n●  What role is there for the transatlantic relationship? Are the US and the EU privileged partners or competitors like any other?\n●  How will we navigate through trade tensions to lower costs and increase profits and how will the shift from “Just in Time” production to “Just in Case” production tie in with existing and new to be negotiated trade agreements?\n●  How to deal with Intellectual Property and concerns around dependencies regarding key industries (tech sector and healthcare sectors for example)?\n●  Is a strategy of low-cost supplies and minimum inventories still viable in a (post) COVID-19 world?\n●  Will reshoring give us the guarantee of access to certain food and medical goods?\n●  How to establish a business with increased flexibility\, agility and resilience?\n\nYou will learn how to best prepare for future challenges and what crisis-management mechanisms to develop and how can companies mitigate future risk.\n\nSPEAKERS:\n●  Patricia Gomes\, Head Global Trade and Receivables Finance North America\, HSBC\n●  Mark Ludwig\, National Leader Trade Advisory Services\, RSM\n●  Rupert Schlegelmilch\, Director DG Trade\, EUROPEAN COMMISSION\n●  Vijay V. Vaitheeswaran\, US Business Editor\, THE ECONOMIST [Moderator]\n\nRegister here.\n\nThis webinar is free for EACC members and EACC non-members. SUMMARY:The Future of Trade: How can Europe and the United States join forces to rewrite the post-COVID trade agenda
DESCRIPTION:Under the Biden administration\, Americans and Europeans need to rebuild as close a transatlantic relationship as possible. Transatlantic partners may have different viewpoints on some specific trade issues. But both sides have much to gain by moving forward trade negotiations in many areas and intensifying the closest trade relationship there is between any two big markets in the world.\n\nWhat is needed is no less than an ambitious trade agenda\, for modernising the WTO so that it can be relevant to today’s problems\, for a new agenda for market access\, securing a level playing field in the face of market-distorting subsidies by actors that follow a different economic and strategic philosophy than Europe and America\, and for sectoral transatlantic agreements in areas like professional recognition of qualifications\, freedom of Movement\, and types of trade in services not covered by the WTO’s “essentially all trade” requirement for agreements.\n\nThe COVID-19 crisis has ushered in a paradigm shift in our thinking about supply chains. Instead of efficiency\, resilience is getting more important. This would be a great area of cooperation for transatlantic trading partners who know they can rely on each other when it comes to health supply chains and other critical products.\n\nSPEAKERS:\n● Pascal Lamy\, President Emeritus\, JACQUES DELORS INSTITUTE\, Former Director-General\, WORLD TRADE ORGANIZATION (WTO)\n● William Alan Reinsch\,  Senior Adviser and Scholl Chair in International Business\, CENTER FOR STRATEGIC AND INTERNATIONAL STUDIES (CSIS)\, Former President\, NATIONAL FOREIGN TRADE COUNCIL\n● Jonathan Hackenbroich\, Policy Fellow\, EUROPEAN COUNCIL ON FOREIGN RELATIONS [Moderator]\n\n \nThis program is brought to you by EACCNY \nREGISTER HERE

SUMMARY:Fund Structuring across the EU: “Why my jurisdiction is better than yours!”
DESCRIPTION:[vc_row][vc_column][vc_column_text]This EACC webinar is brought to you by the EACC New York. \n\nAssets are being relocated and a number of European jurisdictions are seeing an influx of funds. As each European country has their own regulations\, it seems that some countries may be changing their legislation to be more competitive!\n\nJoin us for a highly interactive session where we will bring a selection of panelists from different EU jurisdictions to make the case for “their” jurisdiction and “compete” against each other by comparing the pros and cons to convince the audience why their country is more attractive to invest\, based on 3 scenarios we selected.\n\nScenario I: The US is a fertile market for investment in venture capital\, private equity and publicly traded stocks and investments.  Foreign investors however\, are rightly concerned about US tax and litigation entanglements.  One structure that facilitates these investments is to use a “blocker” entity that invests in the US and into which the non-US investors invest.\n\nIssues encountered in this scenario:\n● US withholding tax and FATCAUS estate and gift taxes and state inheritance taxes\n● US accreditation and qualified investor requirements\n● US AML and privacy rules\n● Access to the US legal system for redress and resolution of claims\n● US limitations on the use of finders and other unlicensed market participants\n\nScenario II: US investment managers see investment opportunities in the EU and UK\, in both publicly traded securities and private placements\n\nIssues encountered in this scenario:\n● EU/UK taxes on returns — availability of treaties and reclaim procedures (US mutual funds will often shy away from EU investing because of the gauntlet they must run to secure tax reclaims).\n● EU and local rules on private investment are confusing (to US investors)\n● French (and other proposed EU) transaction taxes:  too much friction?\n\nScenario III: US investment managers see untapped markets in the EU to sell their US-based/managed investment strategies (such strategies may be US based and/or have a global footprint).\n\nIssues encountered in this scenario:\n● Reverse solicitation — does it work?\n● Internet solicitation — where is the “line”?\n● GDPR is incompatible with US SEC recording keeping rules applicable to US registered advisers.\n● AIFMD/MFID Rules and use of Irish\, Lux\, or Cyprus pools and managers (with US advisers) to passport into Europe; the future of the UK in this regard?\n\nOur panel will discuss what the applicable rules are\, what the quantitative impact of the indigenous taxes is and what the costs for compliance are. If you are a fund manager or working with investors across Europe and the US this is a discussion not to be missed.\n\nSPEAKERS:\n● Raffaele Sansone\, Associate\, GIANNI\, ORIGONI\, GRIPPO\, CAPPELLI & PARTNERS\n● Luc Courtois\, Partner\, NAUTADUTILH\n● Greg Nowak\, Partner\, TROUTMAN PEPPER (Moderator)\n● Conor Durkin\, Partner\, MASON HAYES & CURRAN\n\nTIME:\n10:00am EST / 4:00pm CET\n\nREGISTRATION FEE:\nEACC Members: Free\nEACC non-Members: Free[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][vc_column_text][vc_btn title=”REGISTER” style=”flat” color=”primary” size=”lg” align=”center” button_block=”true” link=”url:attendee.gotowebinar.com/register/685219353839641357?source=EACCFL/WN_NSkHMubNSv6c3g_-lMz-TA|target:%20_blank|”][/vc_column_text][/vc_column][/vc_row]
