Our EACC Chapter in New York is organizing an exclusive conversation with Paolo Gentiloni, European Commissioner for Economy, to discuss how Europe is addressing these challenges: staying the course on its green transition, preserving its industrial competitiveness and defending an open, rules-based multilateral economic order.

While on a business mission to Paris and London led by the Miami-Dade Beacon Council, EACC Florida President Alan Sutin (Greenberg Traurig, LLP) and Board Member Peter Stratos (Kaufman Rossin) used the opportunity to meet with Guillaume Martinez (Alvarez & Marsal), President EACC France and James Rosener (Troutman Pepper), President of EACCNY and EACC France Board Member, as well as with Katherine Prewitt, Executive Director at EACC France, for an exchange about the EACC Network.
Farewell to Consul Generals of
Germany, Italy and The Netherlands
Consul Generals come and go and the summer of 2023 will be marked by the departure of at least three of our seven European Consul Generals.

In a bitter-sweet moment, Consul General of Germany Andreas Siegel announced his departure at a lovely reception at his Residence in mid-June. He arrived in Miami just before the Global Pandemic struck and will remain a part of EACC Florida's early story: he attended EACC Florida's launch in February 2020, contributed to EACC's COVID19 Impact Stories during lock-down, and participated in EACC's webinar on "Building The 21st Century Workforce With Innovative Apprenticeships" held during Germany's Presidency of the EU.

Also departing this summer is Consul General of The Netherlands Ruth Emmerink who attended our launch in February 2020 as well. She will be remembered by a number of sports and soccer-related projects and for contributing Dutch expertise to local discussions on sea-level rise, climate change, urbanism, public transportation, cycling infrastructure, etc. Most notably, the first ever official raising on Europe Day 2023 of the EU flag in Miami Dade County was her initiative.

Italian Consul General of Italy, Cristiano Musillo also leaves Miami this summer after deepening the ties between Florida and Italy and initiating a number of cultural and scientific projects in our Sunshine State. Christina Sleszynska, was honored to attend a beautiful reception at the Biltmore Hotel in Coral Gables in June to mark the 77th Anniversary of the Italian Republic during which he bid farewell to Miami’s large Italian community.

We thank all three Consul Generals for being Friends of EACC Florida, for their involvement in our community, for being committed Europeans and for leaving their marks in our Sunshine State. We look forward to meeting their successors and to continue working with those that remain notably the Consul Generals of France, Ireland, Romania and Spain.

EU I AI Act Adopted by the European Parliament. Key points include a full ban on Artificial Intelligence (AI) for biometric surveillance, emotion recognition, predictive policing; generative AI systems like ChatGPT must disclose that content was AI-generated ; AI systems used to influence voters in elections considered to be high-risk. The EU-wide reules have yet to be adopted by the EU Member States. Read more.

EU I Anti-Coertion Instrument. This new tool will enable the EU to respond to economic coercion, and therefore to better defend its interests and those of its Member States on the global stage. Counter mesures against a coercing country could include countermeasures against a coercing country could include the imposition of tariffs, restrictions on trade in services, and restrictions on access to foreign direct investment or public procurement.. EU I New Economic Security Strategy. The proposed strategy sets out a common framework for achieving economic security by promoting the EU's economic base and competitiveness; protecting against risks; and partnering with the broadest possible range of countries to address shared concerns and interests. EU I Spain Takes Over Rotating Council Presidency. 1 July 2023 marks the start of Spain's rotating presidency of the Council of the EU. The Spanish presidency will focus its work on four priorities: reindustrialise the EU and ensure its open strategic autonomy, advance in the green transition and the environmental adaptation, promote greater social and economic justice, and strengthen European unity. EU-US I Critical Minerals Negotiations to Start. Concluding an EU-US Critical Minerals Agreement will ensure that as an ally, the EU is granted a status equivalent to US free trade agreement partners pursuant to the US Inflation Reduction Act. EU firms will then be able to compete on a level playing field with US and third country competitors on the US market, such as Chile, the Republic of Korea, and Japan. Read more.
EU-US I 12th EU-US Space Dialogue held in Brussels. This year, the discussion addressed opportunities to deepen EU-US and broader trans-Atlantic space security cooperation including space cybersecurity and multilateral engagements to promote norms, rules and principles for responsible behaviour in outer space. EU-LAC I EIB and Mexico Reinforce Partnership to Finance Country’s Sustainable Development. The agreement will give fresh momentum to the existing strategic partnership between the European Union, the EIB and Mexico. It highlights the key target priority areas of common interest that will be supported under a long-term cooperation initiative, through which appropriate and affordable sustainable finance instruments will be made available to support relevant initiatives. The agreement also paves the way for the creation of a technical working group for collaboration on Mexican programs and projects that would benefit from long-term investment, with favourable conditions, and technical support as needed. EU-LAC I Chile: EU, EIB and KfW to Finance Renewable Hydrogen Projects. With an investment of up to EUR 216.5 million, the platform will support the decarbonisation of Chile’s economy, creating green jobs and generating business opportunities for Chilean and European companies while also helping Europe meet its import demand for renewable hydrogen. EU - LAC I Brazil: EIB grants €200 Million for SMEs and Solar Energy Investment by Households. The entire project will contribute to climate change mitigation in terms of the EU taxonomy. It will help Brazil pursue its targets for more renewable energy sources in annual electricity generation, furthering its ten-year national energy expansion plan. Read more.

Florida I A Detailed Overview of Florida SB 262; New Data Privacy Protections for Florida Residents. On June 6, 2023, Florida Gov. Ron DeSantis signed into law SB 262, which grants Florida consumers certain rights relating to the processing of their personal data by businesses. Parts of SB 262 will come into effect in 2023. No-Buy Zone: Florida’s Ban on some Foreign Buyers has Industry Scrambling for Response. The bill bans nearly all purchases by Chinese nationals and China-based companies. It also bars buyers from what the state deems “countries of concern,” including Venezuela and Russia, from purchasing agricultural land in the state, as well as any real estate within 10 miles of military and critical infrastructure facilities. Using AI to Recruit? You're Legally Responsible for the Bot's Bias, EEOC Says. The EEOC recently warned employers that using algorithmic decision-making tools for hiring strategies could potentially violate existing civil rights laws. Read more.

Under the GDPR, does a company that uses personal information to train an AI need to allow individuals to request that their information be removed from the training data? In the context of AI, some supervisory authorities have suggested that if a company uses publicly sourced data to train an AI (e.g., data scraped from the internet), the only plausible lawful purpose would be either (1) the consent of the individuals whose personal information is being provided or (2) the legitimate interest of the controller. European Commission Guidance for EU Competition-Compliant Possibilities for Cooperation between Competitors in Realizing Sustainability Objectives. Companies often point out that there is a tension between sustainability and antitrust/competition. They argue that European Union (EU) – and EU Member States’ national – competition rules hamper competitor cooperation and innovation regarding sustainability because such rules prohibit arrangements that companies believe are necessary. IRS Warns of ERC Consultants Targeting Taxpayers with Aggressive Claims and High Fees. The Internal Revenue Service, American Institute of Certified Public Accountants and other government agencies have recently published alerts to warn employers and tax practitioners of predatory consultants advising businesses to claim the Employee Retention Credit (ERC) when they may not qualify. Designed to reward companies for increasing investments in research and development, the R&D tax credit can apply to a wide range of manufacturing projects, such as developing new manufacturing processes or new products, experimenting with new materials, creating prototypes, and improving performance or quality of existing products. Florida Electronic Health Records Exchange Act Amended – Health Records Maintained by Qualifying Health Care Providers Must Be Stored in the U.S., U.S. Territories, and Canada Only. On May 8, 2023, Governor Ron DeSantis of Florida signed CS/CS/SB 264, amending a suite of Florida statutes to impose heightened requirements on business activities involving foreign interests. As related to the health care industry, CS/CS/SB 264 amended the Florida Electronic Health Records Exchange Act (“Act”) to, among other things, require “health care providers” that utilize “certified health record technology” to manage health records in an electronic interoperable and digital format.
